Series Overview

In 1940 Muskie purchased the law practice of deceased Waterville attorney Carl Blackington. Muskie maintained the practice until his reelection as governor in 1956. Muskie stopped actively practicing law at that time, though the practice maintained a bank account through 1963.

Most of the law practice's work consisted of civil cases such as probate pleadings, the establishment and management of trustee accounts, divorces and domestic issues, contracts, tax adjudications, and suits filed by individuals and local businesses in the Waterville area. As a justice of the peace, Muskie also performed wedding ceremonies.

The series documents the work of the office primarily through lists of clients and bookkeeping records. Other records document Muskie's purchase and eventual closure of the office, and provide samples of his work. These include public records maintained by Muskie on behalf of Fellows's Brass Foundry corporation, for which he served as clerk, briefs Muskie submitted in court on behalf of a client, and records of a case in which Muskie represented his father in a dispute with a former partner.

The series also includes items that may be of interest to those researching Maine legal or industrial history, including a registries of marriages performed by Blackington and Muskie between 1920 and 1947, an 1881 copy of the bylaws of Waterville, an undated list of property valuations for all land in Waterville, and stock certificates and other documents dating from the 19th and early 20th centuries.

Acquisitions Information

The Edmund S. Muskie Papers were deposited at Bates College in June 1980, when Muskie was named U.S. secretary of state. In 1985, several of Muskie's friends and former staff members, with assistance from the College, raised sufficient funds to support the renovation of the former women's gymnasium into the Edmund S. Muskie Archives building, which was dedicated in September of that year. Muskie's papers were formally donated to Bates College on April 23, 1986. Intellectual property rights in the unpublished writings of Edmund S. Muskie were given to the College in an addendum to the deed of gift signed December 8, 1989. The right to dispose of items from the collection was granted to the College by the Muskie heirs in 2007.

In 1994 and in 1996, Bates College received two shipments of records documenting Muskie's life since leaving public office which were maintained in his Washington, D.C. law office. A third accretion was received from the estate of Jane G. Muskie in 2005 and accessioned in 2006. Relatively small groups of files donated at various times by former Muskie staffers and others have also been integrated into the collection. Accession No.: 001-80-01, 001-86-01.

Separated Materials

Significant portions of this series -- over 135 boxes of material -- have been deaccessioned. Materials that were removed from the collection included notes from a bookkeeping class taken by Muskie's sister Lucy, blank forms, legal publications and advertisements, attorney/client priviledged case files, and financial records (e.g., receipts, bank statements, check stubs and ledgers) that duplicated content present in more concise form in the records that were maintained. Additionally, Muskie's notes from law school were moved to Series I: Personal and Family Records, where they join his other academic manuscript material. A container list for the series as it originally existed is available upon request.
